Free Appropriate Public Education (FAPE)

Introduction

The guiding principle in the Individuals with Disabilities Education Act (IDEA) is the provision of a free and appropriate public education (FAPE) to students with disabilities. In some sense, all of the specific provisions in IDEA are in place to promote FAPE. Appropriateness is not clearly defined in IDEA and is a source of ongoing debate. FAPE has been examined by the Supreme Court and is a concept that continues to evolve, varying by Circuit Court.
